Does Belgium opt into EU Inc?
Belgium has a published signal: in May 2026 it co-signed the Benelux non-paper with the Netherlands and Luxembourg, welcoming the EU Inc proposal — and arguing it could have gone further towards a genuinely supranational framework — while demanding safeguards on KYC/AML controls, employee participation rights and the primacy of financial-sector legislation. Supportive but conditional: the regulation is not yet adopted, and Belgium votes in Council by qualified majority. Belgian law firms such as Eubelius have dissected the text for their clients.
The natural domestic comparison is the SRL/BV (société à responsabilité limitée / besloten vennootschap), the default startup vehicle since the 2019 company-code reform abolished its minimum capital — meaning EU Inc’s no-capital pitch is less of a novelty in Belgium than elsewhere.
