Does Denmark opt into EU Inc?

· informational

Denmark’s written input in Council is constructive: it “welcomes” the proposal’s wallet-by-default principle and generally supports building the regime on EUDI and European Business Wallets, while demanding clarity on how the text meshes with national rules on employee representation and signatory rights (Council working document WK 9143/2026). Danish Entrepreneurs is an official partner of the eu-inc.org campaign. No formal government position has been published; the Council decides by qualified majority, and the regulation is not yet adopted.

The default Danish startup vehicle is the ApS (anpartsselskab), the low-capital private limited company. Among our comparisons, the nearest analogue is the GmbH family — see EU Inc vs GmbH — and follow the tracker for the live legislative state.
