Does Malta opt into EU Inc?
Malta’s government has published no position on EU Inc. The clearest public signal so far is ecosystem-level: a Malta Business Bureau analysis (April 2026) notes that the initial Maltese reaction focused on perceived risks to national tax and employment rules — concerns its author considers unfounded on the legal text — and that the MBB intends to engage the government on the file. The regulation is not yet adopted; Malta will decide with the other member states in Council by qualified majority.
Malta’s default startup vehicle is the private limited company (Ltd) under the Companies Act, the standard form for the island’s tech and iGaming companies. EU Inc would be an optional alternative, not a replacement; see the tracker for the live legislative state.
